hoa - collection - 1 - Pete & Des

The homeowner’s association has the burden of creating and enforcing the rules and regulations that keep the neighborhood looking nice and the environment quiet and peaceful. They are also responsible for the upkeep and repairs of community areas. When the association fees go unpaid, the HOA loses income. Bills can not be paid and the entire neighborhood suffers the consequences of inadequate resources and disrepair.

THS firmly believes that in most cases, nonjudicial collection is the better assessment collection option. But we also understand that there are circumstances where suing a particular delinquent owner is appropriate, especially when that owner has assets and the property is underwater, worth less than the loan secured on the property.

Our litigation team will evaluate the owner and determine if there are assets, file the assessment collection lawsuit, and prosecute that lawsuit to judgment for the delinquent assessments, late fees, interest, as well as the collection and attorney’s fees and costs. And, our team will make every effort to collect on that judgment, including writs of execution and the recording of abstracts of judgment.

THS Full Range of Collection Services Include:

  • Initial Demand Letter & Follow Up
  • Skip-Tracing Service
  • Preparation of Court Paperwork
  • Service of A Lawsuit
  • Attorney Time Included
  • Post Judgment Collection
  • Monthly Reporting on Every Case
